अंतरराष्ट्रीय महिला दिवस (International Women’s Day) हर वर्ष 8 मार्च को दुनिया में मनाया जाता है. यह दिन दुनिया के विकास में महिलाओं (Women) के योगदान और संघर्ष को याद दिलाता है. mobycapsule.com की International Women’s Day स्पेशल सीरीज में आज भारत के 6 प्रमुख कानून (Laws) के बारे में पढ़ें. जिनकी जानकारी हर महिलाओं को होनी चाहिए. क्योंकि, यही वो कानून हैं. जिससे महिलाएं अपने अधिकार और सुरक्षा को लेकर जागरूक (Awareness) हो सकती हैं.
महिलाएं अब निर्बल नहीं, अब सबला बन गई हैं. नभ, थल और जल में उनकी कीर्ति फैल रही है. प्राचीन समय से ही समाज में महिलाओं का योगदान सबसे अहम रहा है. अब एक महिला की अपनी इच्छाएं और अपने सपने हैं. इतना ही नहीं, आज महिलाओं को इच्छा और सपने पूरे करने का अधिकार भी उनको मिला है. मगर, अधिकतर महिलाओं को अपने अधिकार (Rights) और काननू (Laws) ही मालूम नहीं हैं. इसलिए सबसे पहले हर महिला को अपने अधिकार और कानून को लेकर जागरुक (Awareness) होना. जिससे वे अपनी लड़ाई खुद लड़ेंगी तो उनकी ताकत और बढेगी. जिससे समाज में उनके साथ किए जाने वाला भेदभाव या अत्याचार भी कम होगा.
काननू (Laws) नंबर-एक: यौन हिंसा और प्रताड़ना का विरोध
अक्सर करके हमें आए दिन कार्यस्थल पर महिलाओं के साथ यौन हिंसा और प्रताड़ना की खबरें पढ़ने को मिलती हैं. इसको लेकर 3 सितंबर-2012 में पहली बार लोकसभा में और 26 फरवरी-2013 को राज्यसभा से महिलाओं की सुरक्षा का काननू पॉश– द सेक्सुअल हैरेसमेंट ऑफ विमेन एट वर्कप्लेस (प्रिवेंशन, प्रोहिबिशन एंड रीड्रेसल बेनिफिट एक्ट, 2013) में पारित हुआ था. जो 9 दिसंबर-2013 से प्रभाव में आया. इस कानून में किसी सरकारी या गैरसरकारी दफ्तर में दस या उसे ज्यादा महिलाएं काम करती हैं. वहां पर पॉश कमेटी अनिवार्य बनानी होगी. वैसे सुप्रीम कोर्ट ने 1997 में वर्कप्लेस सेक्सुअल हैरेसमेंट केस में स्वत: संज्ञान लेकर गाइडलाइंस जारी की थीं. यह काम राजस्थान का बहुचर्चित भंवरी देवी केस था. भंवरी देवी एक एनजीओ में काम करती थीं.
काननू (Laws) नंबर-दो: घरेलू हिंसा से बचाव
भारत में 26 अक्तूबर-2006 को प्रोटेक्शन ऑफ वुमेन फ्रॉम डोमेस्टिक वॉयलेंस कानून लागू हुआ था. इस कानून का उद्देश्य हर प्रकार की घरेलू हिंसा रोकना था. जिससे महिलाओं की रक्षा हो सके. क्योंकि, नेशनल फैमिली हेल्थ सर्वे के आंकड़ों को लेकर यूएन और विश्व स्वास्थ्य संगठन कह ओर से अपील की जा रही थी. आंकड़ों के मुताबिक, भारत में 70 फीसदी महिलाएं घरेलू हिंसा की शिकार हैं. जबकि, इनमें से 10 फीसदी महिलाएं ही घरेलू हिंसा की शिकायत करती हैं. तब सन 2006 में यह कानून आया. जिसमें सभी पहलुओं को शामिल किया गया है. इसमें एक यह भी पहलू है कि, पीड़ित व्यक्ति के साथ घरेलू हिंसा का आभास हो रहा था. वो भी महिला घरेलू हिंसा की शिकार की पुलिस से शिकायत कर सकता है.
काननू (Laws) नंबर-तीन: पिता की संपत्ति में अधिकार
स्वतंत्र भारत में सबसे जरूरी व एतिहासिक कानून हिंदू सक्सेशन एक्ट या हिंदू उत्तराधिकार कानून (2005). जो पहले कानून 1956 के नाम से जाना जाता था. मगर, इसमें लड़के और लड़की को लेकर भेदभाव था. जिसकी वजह से लड़कियों को पिता की संपत्ति में कोई अधिकार नहीं था. सन 2005 में इस कानून में संशोधन करके इस कानून को 9 सितंबर-2005 में लागू किया. जिससे पुराना लैंगिक भेदभाव खत्म हुआ. जिसके तहत पैतृक संपत्ति में भी लड़कियां बराबर की हकदार हैं.
काननू (Laws) नंबर-चार: दहेज प्रथा का विरोध
भारत में डाउरी प्रॉहिबिशन एक्ट या दहेज निषेध अधिनियम-1961 लागू है. इसमें दहेज लेना या देना भी कानूनन अपराध है. इसमें पांच साल की कैद और 15000 रुपए जुर्माना है. आईपीसी की धारा 498 ए दहेज उत्पीडन की है. इसमें कठोर कार्रवाई और एफआईआर होने पर गिरफ्तारी होती है. इसमें जमानत का प्रावधान नहीं था. मगर, बड़ी संख्या में दहेज के झूठे केस दर्ज होने पर यह कानून वापस नहीं हुआ. लेकिन, न्यायालय ने इस कानून के प्रावधानों में कुछ ढील दी है. जिससे अब तत्काल गिरफ्तारी नहीं है. अब जमानती का भी प्रावधान है.
काननू (Laws) नंबर-पांच : मातृत्व अवकाश का अधिकार
भारत में मैटर्निटी बेनिफिट एक्ट 1961 लागू है. जिसमें हर कामकाजी महिला को मातृत्व अवकाश का अधिकार है. यह कानून हर हर सरकारी और गैरसरकारी कंपनी पर लागू है. 11 अगस्त-2016 को मैटर्निटी बेनिफिट (एमेंडमेंट) बिल या मातृत्व लाभ (संशोधन) बिल राज्य सभा और 9 मार्च-2017 को लोकसभा में पास हुआ था. इसके बाद 27 मार्च-2017 में यह कानून बना. पहले मैटर्निटी बेनिफिट एक्ट 1961 के तहत तीन माह का अवकाश हर कामकाजी महिला को मिलता था. जिसे सन 2017 में बढ़ाकर छह माह किया गया है.
काननू (Laws) नंबर-छह: अबॉर्शन का अधिकार
भारत में हर को अबॉर्शन का अधिकार है. जिसके तहत महिला अपने गर्भ में पल रहे शिशु को अबॉर्ट कर सकती है. महिला को इसके लिए अपने पति या ससुरालीजनों की सहमति की जरूरत नहीं है. महिलाओं को यह अधिकार द मेडिकल टर्मिनेशन ऑफ प्रेग्नेंसी एक्ट, 1971 (The Medical Termination of Pregnancy Act, 1971) के तहत मिला है. जिसमें 24 सप्ताह से कम की प्रेग्नेंसी होने पर महिला अबॉर्शन करा सकती है. स्पेशल केसेज़ में महिलाएं अपनी प्रेग्नेंसी के 24 हफ्ते के बाद भी अबॉर्शन करा सकती हैं.
